§ 14-316. Redevelopment criteria.

  • (a)

    Threshold requiring establishment of new landscaping. When any improvement or renovation is proposed which requires the issuance of a building permit, the property shall comply with the requirements of subsection (b) below. When any property is improved or renovated to the extent that the estimated cost of improvements exceeds 50 percent of the fair market value, the property shall comply with the requirements of subsection (c) below. However, any improvement required to meet existing city code regulations, or permits issued for any fences or signs, or other miscellaneous improvements valued at less than $1,000.00, shall be exempt from these requirements.

    (b)

    Minor improvement program. When building improvements trigger the need to comply with this subsection, the following landscape improvements shall be installed as a condition of the building permit issued for those improvements:

    (1)

    Wherever there are existing unpaved areas along the perimeter of the property, perimeter plantings required by code shall be installed, as physically possible.

    (2)

    Wherever there are existing unpaved areas within the parking lot, parking lot plantings required by code shall be installed, as physically possible.

    (3)

    Where there are no existing unpaved areas as identified in subsections (1) or (2) above but there are other areas available for installation of new landscape material, including removal of unnecessary pavement, such material shall be installed based on paralleling the above code requirements, as physically possible.

    (c)

    Major improvement program. When building improvements trigger the need to comply with this subsection, a new final development (site) plan shall be submitted that includes the implementation of a new landscape plan meeting current code requirements. Exceptions to meeting current codes may be granted for existing construction that encroaches into required landscape areas, where relocation and redesign is infeasible.
