§ 18-171. Definitions.
The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Charitable organization means a group which is or holds itself out to be a benevolent, educational, voluntary, health, philanthropic, humane, patriotic, religious or eleemosynary organization or any person who solicits or obtains contributions solicited from the public for charitable purposes. A chapter, branch, area, office or similar affiliate or any person soliciting contributions within the state for a charitable organization which has its principal place of business outside the state shall be a charitable organization.
Charitable purpose means any charitable, benevolent, philanthropic, patriotic, or eleemosynary purpose for religion, health, education, social welfare, arts and humanities or civic and public interests.
Solicitor or solicitations for charitable organizations means the request directly or indirectly for money, credit, property, financial assistance, or other thing of value on the plea or representation that such money, credit, property, financial assistance, or other thing of value will be used for a charitable purpose as those purposes are defined in this section, and include the following methods of securing such money, credit, property, financial assistance, or other thing of value:
(1)
Any oral or written request.
(2)
The making of any announcement to the local press, over the radio or television, or by telephone or telegraph, concerning a local appeal or campaign to which the public is requested to make a contribution for any charitable purpose connected therewith.
(3)
The distribution, circulation posting, or publishing of any handbill, written advertisement, or other local publication which directly or by implication seeks to obtain public support.
(4)
The sale of, offer of, or attempt to sell any advertisement, advertising space, book, card, tag, coupon, device, magazine, membership, merchandise, subscription, flower, ticket, candy, cookies, or other tangible item in connection with which any appeal is made for any charitable purpose, or when the name of any charitable person is used or referred to in such an appeal as an inducement or reason for making any such sale, or when, in connection with any such sale, any statement is made that the whole or any part of the proceeds from any such sale will be donated to any charitable purpose.
Solicitation shall be deemed to have taken place when the request is made, whether or not the person making the request receives any contribution.
