§ 18-299. Presumption established.

  • (a)

    Illicit synthetic drug . Product packaging that indicates, suggests or implies that a substance mimics the pharmacological effects of cathinone, methcathinone, amphetamines, cannabis, cannabinoid, cocaine or MDMA creates a presumption that the person displaying or offering the substance for sale knows or should know that the substance contains an illicit synthetic drug as defined in this article.

    (b)

    Drug paraphernalia . The sale or possession of any metal, wooden, acrylic, glass, stone, plastic or ceramic pipes (with or without screens, permanent screens, hashish heads or punctured metal bowls); water pipes; carburetion tubes and devices; smoking and carburetion masks; roach clips, miniature cocaine spoons and cocaine vials; chamber pipes; carburetor pipes; electric pipes; air-driven pipes; chillums; bongs; ice pipes or chillers, together with an illicit synthetic drug shall create a presumption that the seller or possessor knows or should know that the device has been used or is intended to be used to ingest, inhale, or otherwise introduce the illicit synthetic drug into the human body.
