§ 26-40. Responsibility for removal and remedial action.

  • Any person responsible for the release of a hazardous material shall immediately institute and complete all action necessary to remove and remedy the effects of such release. The city is authorized to respond to the release of a hazardous material in accordance with applicable state and federal laws and in the following circumstances:

    (1)

    At the request of another governmental entity.

    (2)

    When the person responsible for a release does not take immediate action to remove and remedy the effects of such release.

    (3)

    When a release occurs on private property and the person responsible cannot be identified, located or notified.

    (4)

    When the city manager determines that such response is reasonably necessary under the circumstances to protect the public health, safety or welfare or the environment.
