§ 2-3. Official city seal and logo; description; custody; prohibited use.

  • (a)

    Seal design. The official seal of the City of Port Orange shall be an impression or stamp and have a vertical diameter of 1 15/16 of an inch and a horizontal diameter of 1 14/16 of an inch, with an internal circle consisting of a depiction of a body of water with three waves representing a "port" city, a live oak tree representing the city's natural beauty, and the year "1867" representing the year the City of Port Orange was recognized by the U.S. Post Office overlaid on the roots of the live oak tree. The seal shall have an outer circle consisting of the words, "CITY OF PORT ORANGE" centered and wrapping around the top portion of the circle; and the word, "FLORIDA" centered and wrapping around the bottom portion of the circle. All lettering and numbering shall be styled in the "Optima" font type. A facsimile of the above described official seal is as follows:

    (b)

    Logo design. The official logo of the City of Port Orange shall be an internal circle consisting of a depiction of a body of water with three waves representing a "port" city, a live oak tree representing the city's natural beauty, and the year "1867" representing the year the City of Port Orange was recognized by the U.S. Post Office overlaid on the roots of the live oak tree. The logo shall have an outer circle consisting of the words, "CITY OF PORT ORANGE" centered and wrapping around the top portion of the circle; and the word, "FLORIDA" centered and wrapping around the bottom portion of the circle. All lettering and numbering shall be styled in the "Optima" font type. A color facsimile of the above described official logo is as follows:

    (c)

    Logo coloring. The Pantone Matching System ("PMS") shall be employed when using a color city logo. The live oak tree shall be colored number PMS-576 outlined by a thin PMS-Black border. The water shall be colored number PMS-278 outlined by a thin PMS-Black border. The circle shall be colored number PMS-1665 with PMS-Black borders on both the inner and outer parts of the circle. All lettering and numbering on the seal shall be colored number PMS-White with a PMS-Black border.

    (d)

    Custody. The city clerk shall be the custodian of the official city seal.

    (e)

    Record certification. The city clerk or designee of the city clerk may certify under the seal copies of any ordinance, resolution, record, paper, letter or document, by law placed in the custody, keeping and care of the city clerk or designee of the city clerk, and such certified copy shall have the same force and effect in evidence as the original would have. Only the city clerk or designee of the city clerk shall be authorized to affix the seal to any document for the purpose of attesting, certifying or otherwise formalizing such document.

    (f)

    Unauthorized uses.

    (1)

    The manufacture, use, display, or other employment of any facsimile or reproduction of the official municipal seal or logo for the purpose of conveying, or in a manner reasonably calculated to convey, a false impression of sponsorship or approval by the city, or by any department, agency, or instrumentality thereof, is prohibited.

    (2)

    The manufacture, use, display, or other employment of any facsimile or reproduction of the official municipal seal or logo for the purpose of advertising or promoting the sale of any article of merchandise or for any other commercial purpose is prohibited, without prior written approval by the city council.

    (g)

    Penalty. Any violation of this section shall be punishable in accordance with section 1-8 of the Code.
