§ 2-206. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Board attorney means the legal counselor who represents the code enforcement board, who may also be the city attorney.

    City attorney means the legal counselor for the city, any of his or her assistants or his or her designee.

    City council means the legislative body of the city.

    Code enforcement board clerk means the city manager's designated employee or agent of the city whose duty is to prepare and maintain code enforcement case files, prepare legal documents, and act as the recording secretary for the code enforcement board.

    Code enforcement manager means the city manager's designated employee or agent of the city whose duty it is to review all cases referred to the code enforcement board, prepare and present cases, or supervise the presentation of cases to the board and oversee the general operation of the code enforcement board.

    Code compliance inspector means any designated employee or agent of the city whose duty it is to enforce codes and ordinances enacted by the city and this term shall be interpreted to include code inspector wherever the term code compliance inspector is used in this article; provided, however, nothing in this article shall be construed to authorize any person designated as a code compliance inspector to perform any function or duties of a law enforcement officer other than as authorized by law. A code compliance inspector shall not make physical arrests or take any person into custody, and except for fire inspectors shall be exempt from requirements relating to the special risk class of the Florida Retirement System, bonding, and the criminal justice standards and training commission, as defined and required by general law.

    Law enforcement officer means any person who is elected, appointed or employed full-time by any municipality or the state or any political subdivision thereof; who is vested with authority to bear arms and make arrests; and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic or highway laws of the state.

    Repeat violation means a violation of a provision of a code or ordinance by a person who has been previously found to have violated or who has admitted violating the same provision within five years prior to the current violation, notwithstanding the violations occur at different locations.
