§ 58-37. City's right to restore surface.

If the permittee fails to complete restoration work by the estimated date for completion listed in the permit application, the city shall have the right to restore the right-of-way and to charge the permittee for actual costs of such restoration work plus 25 percent of such costs for administrative expenses. In the case of a franchised utility, the actual costs and administrative expenses shall not be eligible for credit against franchise fee payments.
