§ 58-55. Procedure; review criteria.

  • (a)

    Special events. The community development director, or the community development director's designee, shall review the application submitted for completeness. The community development director, or the director's designee, is hereby authorized to reject any application, which is not complete, or which is not received by the specified deadline, or which is not accompanied by the requisite permit fee. Completed applications for special event permits shall be reviewed to determine the anticipated impact on pedestrian and traffic patterns, noise, security, and other aspects of public health, safety or welfare and for compliance with this article. An application may be denied if it is determined that any of the following are true:

    (1)

    The proposed special event cannot be conducted in such a manner as to ensure the public health, safety or welfare consistent with the provisions of this article, or the special event could be conducted in such manner as to ensure public health, safety or welfare only with certain conditions attached and the applicant refuses to accept such conditions as conditions of a permit.

    (2)

    The applicant previously failed to clean up the site of the proposed special event, other property owned by the applicant, or properties adjacent to such site or such other property, of garbage, waste, trash or debris associated with a previous special event, and at the time of application:

    a.

    Such conditions remain; or

    b.

    Such conditions have been remedied by the city, but the applicant has failed to fully reimburse the city for the costs of such remedy.

    (3)

    At the time of application, code violations exist on the site of the proposed special event.

    (4)

    The applicant has previously violated chapter 58, article III.

    (5)

    The property designated to hold the special event has previously been the site of a violation of chapter 58, article III.

    (b)

    A completed application shall be processed as follows:

    (1)

    Minor special events. The community development director, or the community development director's designee, shall ensure that the application is reviewed by all affected city departments. The community development director, or the community development director's designee, may approve or deny such application, or may attach such conditions to an approval as provided by this article. Appeals from the decision to community development director, or the community development director's designee, shall be made to the city manager. The city manager's determination whether to grant or deny an application for a local special event shall be final.

    (2)

    Major special events. The city manager, or the city manager's designee, shall ensure that the application is reviewed by all affected city departments and shall forward the application to the city council for consideration with any recommendations made by the city manager, or the city manager's designee. The city council may approve or deny such application and in approving such application may attach such conditions as provided by this article. The city council's determination whether to grant or deny an application for special event permit shall be final.
