§ 58-59. Public conduct during events on public property.

  • For the health, safety and welfare of the public, a special event on public property shall require prior notification to the city manager if there is a likelihood that the event will either draw more than 200 people, impede traffic, or otherwise disrupt city business. The city manager retains the right to impose reasonable restrictions on the time, place, or manner of the use of public property as necessary to maintain the health, safety and welfare of the public.

    For the health, safety and welfare of the public, it shall be unlawful for any person to carry, possess, exhibit, or display any of the following while participating in any special event on public property or right-of-way:

    (1)

    Weapons, excluding firearms, as defined in section 58-51;

    (2)

    Any projectile launcher or other device that is commonly used for purpose of launching, hurling, or throwing any object, liquid, material or other substance;

    (3)

    Any glass bottles, glass jars, or glass containers with the intent to injure persons or property;

    (4)

    Paint or spray paint;

    (5)

    Balloons filled with anything other than air or helium;

    (6)

    Bricks, stones, rocks or pieces of asphalt or concrete;

    (7)

    Any mask when used with the intent of preventing or hindering law enforcement officers from protecting persons or property, or when used to avoid identification while engaging or attempting to engage in unlawful acts;

    (8)

    Any device when used with the intent to lock a person or persons to other persons or objects and with the intent to interfere with the normal flow or regulation of pedestrian or vehicular traffic upon any facility, street, sidewalk, swale, alley, park, public recreation area or other place or building;

    (9)

    Any toxic or noxious substance;

    (10)

    Notwithstanding the foregoing, any prohibited weapon or item may be carried, possessed or displayed by law enforcement officers, fire/rescue officials, or other government officials at their discretion for public safety purposes during the scope of their employment.

    A law enforcement officer shall notify person(s) in possession of weapons or prohibited items as specified above, that possession of said item(s) is unlawful and said items shall be immediately surrendered as directed by the law enforcement officer, the failure of which may result in arrest, provided, however, no notification is required prior to arrest for possession of a concealed weapon or as otherwise specified in F.S. ch. 790.
