§ 70-37. Parking prohibited at certain times.

  • (a)

    When signs are erected giving notice thereof, no person shall park a motor vehicle at any time on any of the streets so marked by the chief of police. With approval of the chief of police, the city may erect, within the city, permanent traffic signs prohibiting parking on any streets or locations within the city during certain hours. When such signs are erected giving notice of the prohibition against parking, no person shall stop, stand or park a motor vehicle within the area or place during the hours specified by such signs.

    (b)

    No person shall park a motor vehicle in violation of any restriction or prohibition imposed by general law, including restrictions and prohibitions set forth in F.S. ch. 316, known as the Uniform Traffic Control Law, and specifically F.S. § 316.1945, Stopping, Standing or Parking Prohibited in Specified Places; F.S. § 316.195, Additional Parking Regulations; F.S. § 316.1955, Parking Spaces Provided by Governmental Agencies for Certain Disabled Persons; and F.S. § 316.1956, Parking Spaces Provided by Non-Governmental Entities for Certain Disabled Persons.

    (c)

    However, the city council may grant special exceptions to this section during special events. Any person requesting a special exception shall submit to the city manager, in writing, an application which shall set forth the grounds or reasons for the request, the location for which the special exception is being applied, and the proposed duration of the special exception. The application must be submitted to the city manager at least one week before the council meeting at which the request is to be considered. The city manager, the chief of police and the fire chief shall make an advisory recommendation on the request to the council. The council may grant the special exception upon a showing of good cause and shall attach to the special exception all conditions necessary to promote public safety and convenience, including, but not limited to, the expiration date and location of the special exception. The council may revoke a special exception upon a showing that the special exception is having an adverse effect upon public safety and convenience, or that the conditions of the special exception are or have been violated. Moreover, a violation of the conditions of a special exception shall be subject to the penalties provided for violations of other sections of this chapter.
