§ 70-73. Privileges and restrictions on decals and placards.

  • (a)

    The holder of a decal or placard issued pursuant to this article shall be permitted to stand or park a motor vehicle displaying the decal or placard and operated by the holder in designated RDP areas during such times and places as the parking of motor vehicles therein is otherwise permitted. While a vehicle for which a decal has been used is so parked, such decal shall be permanently affixed inside the driver's side front window of the vehicle. A decal or placard shall not guarantee or reserve to the holder a parking space within an area.

    (b)

    A decal or placard shall not authorize the holder thereof to stand or park a motor vehicle in such places or during such times as the stopping, standing or parking of a motor vehicle is otherwise prohibited and shall not exempt the holder from the observance of any traffic regulation including but not limited to those found in chapter 70 and state traffic control laws.

    (c)

    It shall constitute a violation of this article for any person, other than a resident or visitor to use or display a decal or placard, or to attempt to reproduce a decal or placard.

    (d)

    It shall constitute a violation of this article for any person to falsely represent himself as eligible for a decal/placard or to furnish any false information in an application in order to obtain a decal or placard.

    (e)

    The chief of police or his designee is authorized to revoke the decal or placard of any holder found to be in violation of this article. Upon written notification of the violation, the decal holder shall surrender such decal or placard to the police department. Failure, when so requested, to surrender a parking decal or placard so revoked shall constitute a violation of this article. A person who contests the revocation or surrender of a decal or placard may appeal to the city manager within 30 days of the written notification of violation and revocation.

    (f)

    It shall be unlawful and a violation of this article for a person to copy, produce or otherwise bring into existence a facsimile or counterfeit decal or placard in order to evade parking regulations applicable in an RDP area.
