§ 74-102. Purpose, policy and objectives.

  • (a)

    This division sets forth uniform requirements for direct and indirect contributors into the wastewater collection and treatment system for the city and enables the city to provide efficient wastewater treatment to protect the public health and the environment and to comply with all applicable state and federal laws, including the Act, and the General Pretreatment Regulations Title (40 CFR part 403), and Chapter 62-625, F.A.C.

    (b)

    The objectives of this division include, but are not limited to, the following:

    (1)

    Prevent the introduction of pollutants into the WWF which will interfere with the operation of the system or contaminate the resulting sludge or reclaimed water, or otherwise be incompatible with the WWF.

    (2)

    Prevent the introduction of pollutants into the WWF which will pass through the system, inadequately treated, into receiving waters, reclaimed water, sludge, or the atmosphere or otherwise be incompatible with the WWF.

    (3)

    Promote recycling and reuse of industrial wastewaters and sludges from the WWF.

    (4)

    Provide for fees regarding equitable distribution of the cost of the WWF.

    (5)

    Provide for the general health, safety and welfare of both utility employees and citizens of the city.

    (6)

    To enable the city to comply with its NPDES permit conditions, sludge use and disposal requirements, and any other federal or state laws with which the WWF must comply.

    (c)

    This division provides for the regulation of direct and indirect contributors to the WWF through the issuance of permits to certain nondomestic industrial users and through enforcement of general requirements for the other industrial users; authorizes monitoring and enforcement activities; requires industrial user reporting; assumes the existing customer's capacity will not be preempted; and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein. These fees may be set by resolution of the city council.

    (d)

    This division shall apply to the city and to persons outside of the city who are, by contract or agreement with the city, industrial users of the city's WWF and/or COPOSS. Except as otherwise provided herein, the city manager or his designee, shall administer, implement and enforce the provisions of this division. The city manager or his designee shall periodically review such provisions and limitations to ensure that they are sufficient to protect the operation of the WWF and/or COPOSS, to enable the treatment works to comply with applicable state and federal laws, to provide a cost effective means of operation of the treatment works, to provide cost effective opportunities to recycle and reclaim the sludge and effluent of the treatment works, and to protect the public health and the environment. The city manager or his designee shall recommend changes or modifications to this division as necessary.
