§ 3.03. Mayor and vice mayor.

  • (a)

    The mayor shall preside at meetings of the council, shall be recognized as head of city government for all ceremonial purposes, by the governor for purposes of military law, for service of process, execution of contracts, deeds, and other documents, and as the city official designated to represent the city in all agreements with other governmental entities or certifications to other governmental entities, but shall have no administrative duties except as required to carry out the responsibilities herein. The mayor shall annually present a state of the city message, present the agenda for all meetings of the council, name committees of the council and, in consultation with the council, shall appoint members of the city boards with the approval of the council.

    (b)

    The mayor shall be an elector of the city elected to a four-year term by the electors of the city, except as otherwise provided in this charter.

    (c)

    Both the mayor and the vice mayor shall be entitled to vote at all council proceedings.

    (d)

    The vice mayor shall be elected at the first meeting of the newly elected council after the regular city elections; and, in nonelection years, at the first regular council meeting in January and commencing in 2007 at the first regular council meeting in December. The vice mayor shall act as mayor during the absence or disability of the mayor. In case of death, resignation, or removal of the mayor, the vice mayor shall serve as mayor for the remaining unexpired term of such office. The council vacancy left by the vice mayor shall be filled as provided in section 3.05(c). A vice mayor shall be elected by the council from its members either before or after the filling of the council vacancy as provided in the preceding sentence. In all instances, the vice mayor shall be elected by the affirmative vote of the majority of the council.

    Exemption from [F.S.] Chapters 98-506 and 95-462. Pursuant to the applicable procedures in [F.S.] Chapter[s] 98-506 and 95-462, the city exempts itself from the requirements of these laws and shall hold its elections as otherwise set forth in Ordinance No. 2008-35.
