§ 56-42. Application review.

  • The city manager shall review the application prior to any action granting an initial franchise, or approving a material modification of an existing franchise.

    (a)

    Selection criteria. In evaluating an application for an initial franchise, or a material modification of an existing franchise, the city manager shall consider all of the following criteria:

    (1)

    The public need for the proposed franchise.

    (2)

    The financial ability of the applicant to perform.

    (3)

    The applicant's experience.

    (4)

    The adequacy of the applicant's equipment and facilities in relation to the services to be rendered.

    (5)

    The sanitation, safety and reliability of the applicant's collection equipment.

    (6)

    Such other matters or information regarding the applicant or proposed franchise that the city manager may determine to be relevant in his or her determination.

    (b)

    City council determination. Based on the evidence presented in the application and any other evidence that the city manager deems relevant, the city manager shall either grant or deny the application, and may prescribe such conditions or restrictions on the applicant or franchise that the city manager deems necessary to protect the interest of the general public.
