§ 56-41. Filing of application.

(a)

Providing copies of application. An applicant for an initial franchise, or a material modification of an existing franchise, shall file the original of the application with the city manager, or his or her designee.

(b)

Filing fee. Contemporaneously with the filing of an application for an initial franchise or a material modification of an existing franchise, the applicant shall remit to the city a nonrefundable application fee in the amount established by resolution of city council for the applicable application, unless otherwise prohibited by law or waived by the city council. "Material modification" shall mean a change in any term or condition that substantially or materially affects any right or obligation of the franchisee or city under a franchise.
