§ 70-67. Guidelines.

(a)

Generally. The location and time restrictions for an RDP area designated pursuant to this article shall be established and approved by the city council upon adoption of a resolution.

(b)

Parking decal/placard placement. All decals shall be permanently affixed to the driver's side windshield in a manner visible from the outside of the vehicle. All placards shall be placed on the driver's side dashboard in a manner visible from the outside of the vehicle.

(c)

Parking decal/placard fees. The annual fee and renewal fee for decals and placards.

(d)

Penalties, liability and enforcement. Penalties, liability and enforcement shall include the following:

(1)

Any person parking or failing to remove a vehicle without a decal or placard in an RDP area during the time prohibited shall be deemed to have committed a noncriminal violation and shall be ticketed pursuant to section 70-33; and

(2)

An unattended vehicle without a valid decal or placard properly displayed in an RDP area during a prohibited time shall be in violation of this article and the city shall be authorized to remove and impound the vehicle pursuant to section 70-6, at the vehicle owner's expense; and

(3)

Anyone violating or failing to comply with any of the requirements of this article shall be guilty of violation of this Code, subject to the penalties set forth in section 1-8; and

(4)

Revocation of the decal or placard.
