§ 18-301. Penalty.

(a)

A person violating any of the terms, conditions, regulations, limitations or provisions of this article shall be punished in accordance with sections 1-8 and 2-224. Each day that any violation of the terms, conditions, regulations, limitations or provisions of this article shall continue to exist shall constitute a separate and distinct offense, punishable as herein provided.

(b)

Any proceeds gained from any violation of this article shall be forfeited to the City of Port Orange pursuant to the procedures set forth in the Florida Contraband Forfeiture Act.

(c)

Any person found guilty, regardless of whether adjudication is withheld, of any violation under this article shall be liable for payment of the costs of prosecution and all investigative costs incurred, including but not limited to any cost for laboratory testing.

(d)

Any continuing violations of the terms, conditions, regulations, limitations or provisions of this article may be enjoined and restrained by an injunctive order of the circuit court in appropriate proceedings instituted for such purposes.
